Terms of Service (TOS)

1. Scope and Acceptance

By creating a basic account you acknowledge and accept these Terms of Service. The basic registration does not grant access to additional features but starts the advanced registration process (buyer and/or seller profile and/or agent).

2. Eligibility and Age

  • Access is restricted to users of legal age as defined by their country of residence.
  • Fanshap does not host nudity or pornographic content; only creator profile photos and links to external platforms are displayed.
  • Users must comply with external platforms’ policies when following outbound links.

3. Accounts and Advanced Registration

Seller profiles may be partially visible to visitors (e.g., nickname and country). Sensitive details are only visible to authenticated users and processed according to the Privacy Policy.

  • Buyer profile: full shipping details, wallet address, phone with international prefix, Telegram/WhatsApp (optional), acceptance of privacy and health-risk notices.
  • Seller profile: nickname (public), name/surname and address (private), country (public), contacts, links to show platforms, USDT wallet, acceptance of the sales contract (50/50 split), health status declaration, media of the show.

4. Prohibited Activities and Product Restrictions

  • Illegal activities of any kind (including trafficking of unlawful goods) are strictly forbidden.
  • No sale of items that violate hygiene/health regulations.
  • No weapons, drugs, counterfeit or sanctioned goods. Customs laws of origin/destination must be respected.
  • Listings must be accurate and lawful; Fanshap may remove or ban items or accounts at its discretion.

5. Payments on Solana (SPL tokens)

Fanshap operates on Solana using SPL tokens. For each product, the Seller may accept USDT (SPL), USDC (SPL) and/or FSHAP (utility token). On-chain transfers are irreversible; Users must double-check addresses and keep a small amount of SOL for fees. Fanshap does not store private keys or seed phrases.

5.1 Checkout and Escrow

  • Payments are sent to a Fanshap vault. After automated verification and shipment confirmation, payouts are released to the Seller.
  • A dispute window (e.g., 72 hours from delivery status) may apply before payout.
  • Each payment includes a reference/memo (order_id) for reconciliation.

5.2 Fees, Refunds and Chargebacks

  • Network fees are paid on-chain and are non-refundable.
  • Refunds, when applicable, are executed on-chain to the original payer address after investigation.
  • No chargebacks are available for on-chain transactions.

6. Shipping, Customs and Taxes

  • Buyers must provide accurate shipping data (including native language address where needed).
  • Incoterms and duties: by default, Buyer bears import duties and taxes unless otherwise stated by the Seller (DDU).
  • Sellers must provide tracking numbers and comply with export laws.

7. Returns and Hygiene Exceptions

Products listed on Fanshap are generally “used / pre-owned” items and may include goods that, by their nature, involve hygiene/health considerations. As a rule, such items are sold “as-is”.

  • EU withdrawal rights may not apply to sealed goods once opened for hygiene or health protection reasons, and to items that cannot be returned for sanitary reasons. Where this hygiene exception applies, returns are not accepted.
  • For used/intimate items that are not reasonably returnable for sanitary reasons, returns are generally not accepted. Each Seller must clearly state the return policy on the product page.
  • If the Seller allows returns for specific non-intimate items, the applicable conditions (timing, state of the item, shipping costs) must be indicated on the order page and strictly followed by the Buyer.
  • Buyers are responsible for ensuring that any purchased used item is sanitized or handled to meet their own hygiene and safety needs. Fanshap does not provide sanitization services.
  • Complaints: if a Buyer encounters issues (e.g., misrepresentation, non-delivery), they may open a ticket from the order page. Fanshap may hold or withhold Seller payout during the review and may take measures up to Seller account suspension or removal.
  • This section does not limit mandatory consumer rights that cannot be waived under applicable law. Where local law grants non-derogable rights, those rights prevail.

8. Disputes

  • Open a ticket from your order page within the stated dispute window.
  • Provide evidence (photos, tracking, correspondence). Fanshap may hold payout until resolution.

9. Account Management and Termination

  • Users may request account deletion. The account is deactivated for 30 days before permanent deletion.
  • Fanshap may suspend or terminate accounts for policy breaches, fraud risks or legal requests.

11. Limitation of Liability

To the maximum extent permitted by law, Fanshap is not liable for indirect, incidental, special, or consequential damages arising from your use of the platform, including blockchain risks, wallet mismanagement, or customs seizures.

12. Changes to the Terms

Fanshap may update these Terms. Material changes will be announced on-site. Continued use after changes constitutes acceptance.
